G.S. 160A-300.1 — a civil penalty of $50, with no license or insurance points
Not an infraction. Where a municipality adopts an ordinance for civil enforcement by camera, running a red light at a camera location is not an infraction. It is a noncriminal violation with a civil penalty of fifty dollars ($50.00), and no license points or insurance points are assigned to the owner or driver.
- The owner is responsible unless the vehicle was in someone else's care, custody or control.
- The owner is not responsible if, within 30 days after notification, the owner furnishes an affidavit naming who had the vehicle, or an affidavit, with supporting evidence, that it was stolen.
- The owner is not responsible if notice reaches the registered owner more than 90 days after the violation.
- The citation states how it may be challenged.
Signs. Cameras are identified by advance warning signs posted not more than 300 feet from the system.
