Changing or Revoking a Will
N.D.C.C. § 30.1-08-07 — a later will, or burning, tearing or cancelling it on purpose
- A later will revokes an earlier one expressly or by being inconsistent with it.
- Burning, tearing, cancelling, obliterating or destroying a will with intent to revoke it revokes it, done by the testator or by another in the testator's presence at the testator's direction.
- A burn, tear or cancellation counts even if it touches none of the words.
- A later will that disposes of the whole estate is presumed to replace the earlier one.
