A Small Estate
N.D.C.C. § 30.1-23-01 — an affidavit after thirty days collects property when the estate is $100,000 or less
Thirty days after a death, anyone holding the decedent's money or property delivers it to a successor who presents an affidavit stating:
- The whole estate, less liens and encumbrances, is worth no more than $100,000.
- Thirty days have passed since the death.
- No application to appoint a personal representative is pending or granted anywhere.
- The successor is entitled to the property.
