Disorderly Conduct
N.D.C.C. § 12.1-31-01 — fighting, unreasonable noise, or harassing acts meant to harass, annoy or alarm, a class B misdemeanor
An individual commits disorderly conduct, a class B misdemeanor, by doing any of these with intent to harass, annoy or alarm someone, or in reckless disregard that someone is:
- Fighting, or violent, tumultuous or threatening behavior.
- Unreasonable noise.
- Abusive or obscene language or an obscene gesture in a public place.
- Obstructing traffic or a public facility, or persistently following someone in public.
- Pointing a surveillance camera into another person's dwelling, after seven days' notice from an officer to redirect it.
A class B misdemeanor carries up to thirty days and $1,500. Constitutionally protected activity is not disorderly conduct, and the court decides that claim as a matter of law.
