Getting Married
N.D.C.C. § 14-03-02 — eighteen to marry, sixteen with a parent's consent, and a license good for sixty days
- An unmarried person eighteen or older may marry; at sixteen or seventeen a license needs a parent's or guardian's consent, and no license issues under sixteen.
- No one may perform a marriage until the couple produces a license issued not more than sixty days before.
- The recorder collects a license fee of up to thirty dollars, plus a thirty-five dollar supplemental fee for domestic violence aid.
A surname does not change automatically on marriage, and neither spouse must change it. Either may choose a new surname on the license application, from the other's surname, a former surname, or a combination of them.
