N.D.C.C. § 39-21-41.2 — a child under eight rides in a child restraint unless 57 inches tall
- A child under eight rides properly secured in a child restraint system that meets federal standards, following the maker's instructions.
- A child under eight who is at least 57 inches tall may use a correctly buckled safety belt instead.
- A child eight through seventeen uses a child restraint or a correctly buckled safety belt.
- A vehicle built without safety belts, and an emergency, are excepted.
The fee for a violation is $25. A violation is not, by itself, evidence of negligence.
