Penalty wages. An employer who willfully fails to pay final wages on time owes the employee's wages at the same hourly rate for eight hours a day until paid or until a suit is filed, for not more than 30 days.
A written notice of nonpayment matters: without one, the penalty cannot exceed 100 percent of the unpaid wages, and with one, it can only if the employer does not pay in full within 12 days. Final pay is mailed to the address the employee gives, on request.
