In Pennsylvania, a driver approaching or passing an emergency response area, unless an emergency responder directs otherwise, or a disabled vehicle, passes in a lane not next to it if possible. Where that is impossible, illegal or unsafe, the driver passes at no more than 20 miles per hour less than the posted limit and at a speed reasonable for passing safely.

  • Causing bodily injury, serious bodily injury or a death in an emergency response area adds a fine of up to $1,000, $5,000 or $10,000.
  • The license is suspended for 90 days on a third conviction, or where the violation caused serious bodily injury or death.
  • Where the person hurt was an emergency responder or someone in or near a disabled vehicle, the suspension is six months for serious bodily injury and one year for a death.
