SDCL § 20-13-10 — hiring, firing and pay, the protected traits, reprisal for a charge, and one hundred eighty days to file
It is unlawful to refuse to hire, to fire, or to treat an employee or intern unequally in hiring, training, promotion, pay, layoff or any term of employment, because of race, color, creed, religion, sex, ancestry, disability or national origin.
It is also unlawful to threaten or take any reprisal, economic or otherwise, against someone for filing a charge, testifying, or helping enforce the chapter.
One hundred eighty days. A charge is filed within one hundred and eighty days after the practice occurred.
