SDCL § 43-31-1 — a family's home safe from judicial sale and judgment liens, and from tax sale for a senior
The homestead of every resident family, while it remains a homestead, is exempt from judicial sale, from judgment liens, and from court process, to the extent the statutes provide.
Seventy and over. A homestead worth less than one hundred seventy thousand dollars of a person seventy years of age or older, or their unremarried surviving spouse, is also exempt from sale for taxes.
A mortgage the owner signed is not defeated by the homestead. A particular home is a question for a licensed South Dakota attorney.
