Hurt at Work
Utah Code 34A-2-407 — notice to the employer within 180 days, or the claim is barred
An employee injured in the course of employment notifies the employer promptly, and a claim for benefits is barred if notice is not given within 180 days after the injury, unless an exception in the section applies. A next of kin or attorney may give notice for an employee who cannot.
Who handles this in Utah: Utah Labor Commission, Workers' Compensation; and legal aid programs and the state offices, listed in the Utah directory.
- An employer and its insurer file a report of the injury as the commission's rules require, and give the employee a copy.
- An employer need not file one for a minor injury, such as a cut that needs only first aid, unless a treating physician files or must file a report.
A claim for death benefits is barred unless an application for hearing is filed within one year of the employee's death.
