Utah Code 13-20-5 — four repair attempts or 30 business days out of service
If a new motor vehicle does not conform to its express warranties and the consumer reports it to the manufacturer or its dealer during the warranty or the one year after original delivery, whichever is earlier, the manufacturer makes the repairs needed.
Who handles this in Utah: Utah Division of Consumer Protection; and legal aid programs and the state offices, listed in the Utah directory.
If a defect that substantially impairs the vehicle's use, market value or safety cannot be fixed after a reasonable number of attempts, the manufacturer replaces it with a comparable new vehicle or takes it back and refunds the full purchase price, less a reasonable allowance for use.
- A reasonable number is presumed where the same problem was repaired four or more times within the period and continues.
- It is also presumed where the vehicle was out of service for repair a total of 30 or more business days within the period.
It is a defense that the problem does not substantially impair use, value or safety, or results from abuse, neglect or unauthorized changes by the consumer.
