Utah Code 13-44-202 — notice to each affected resident when misuse is likely
A person owning or licensing computerized personal information about Utah residents promptly investigates a security breach in good faith, and notifies each affected Utah resident if misuse for identity theft or fraud has occurred or is reasonably likely.
Who handles this in Utah: Utah Division of Consumer Protection; and legal aid programs and the state offices, listed in the Utah directory.
- With 500 or more residents affected, the Office of the Attorney General and the Utah Cyber Center are notified too.
- With 1,000 or more, so is each nationwide consumer reporting agency.
- Notice is given in the most expedient time possible without unreasonable delay, allowing for law enforcement needs and for restoring the system.
