Moving Away with a Child

Utah Code 81-9-209 — 60 days' written notice for a move of 150 miles or more

Relocation means moving 150 miles or more from the other parent's residence, and the relocating parent gives the other parent written notice at least 60 days before the move.

Who handles this in Utah: legal aid programs and the state offices, listed in the Utah directory.

  • The notice affirms that the parent time schedule will be followed and that neither parent will interfere with the other's court ordered parent time.
  • On a motion, or on its own, the court schedules a hearing to review the notice and make orders on the schedule and transportation costs.
  • If the court finds the move is not in the child's best interest and the custodial parent moves anyway, it may order a change of custody.
