Driving While Suspended
23 V.S.A. § 676 — most suspensions make driving a civil violation, but a DUI suspension makes it a crime
Driving on a public highway before reinstatement, after a suspension for most reasons, is a civil traffic violation. A suspension for impaired driving, a civil DUI suspension, grossly negligent operation, or leaving a serious crash is different, and driving under it is a crime.
- Driving during a suspension for grossly negligent operation or leaving a serious crash carries up to two years and $5,000.
- A third civil violation, with the two prior ones within two years, carries the same.
