Resisting Arrest and Eluding
23 V.S.A. § 1133 — failing to stop for a signal is up to a year, and resisting a lawful arrest the same
- A driver may not fail to stop when signaled by an officer displaying insignia, or by a police vehicle sounding a siren with blue lights.
- Eluding carries up to one year and $1,000, and up to five years when driven negligently or grossly negligently.
- When the eluding knowingly causes serious bodily injury to another, it carries up to 15 years and $5,000.
Intentionally trying to prevent a lawful arrest by an evident law enforcement officer carries up to one year and $500 the first time, and two years and $1,000 after. A mistaken belief that the arrest was unlawful is no defense.
