The Insurance Suspension
RCW 46.30.020 — a traffic infraction, and a dismissal on proof that the coverage was there
The requirement. No person may operate a motor vehicle subject to registration in the state unless insured under a liability policy with at least the limits RCW 46.29.090 provides, self insured, covered by a certificate of deposit, or covered by a liability bond. Proof is provided on a law enforcement officer's request.
A presumption, and an infraction. Failing to display proof when an officer asks creates a presumption that the person does not have insurance. Failure to provide proof is a traffic infraction.
Dismissal with proof. If the person cited appears before the court or violations bureau with written evidence of compliance at the time of the citation, or mails that evidence before the appearance date, the citation is dismissed, and the court may assess administrative costs of $25.
The phone. An officer shown proof on a portable electronic device may view only the proof and is otherwise prohibited from viewing other content on it. The person presenting it assumes liability for damage to it.
How much coverage the law requires, and anything more that reinstatement takes, are set out in other sections that are not on this page. Whether a particular charge applies is a question for a licensed Washington attorney.
