Identity Theft

W. Va. Code § 61-3-54 — a felony of up to five years for using another person's identity

Knowingly taking another person's name, birth date, social security number or other identifying information without consent, to pose as them for credit or financial transactions or to get a job, is a felony.

The penalty. Confinement of not more than five years, a fine of not more than $1,000, or both.

The section does not cover using another's license only to misrepresent age. A particular case is a question for a licensed West Virginia attorney.
