A Used Car Sold As Is
W. Va. Code § 46A-6-107a — as is only for a cheap, high mileage or older car, and three business days to cancel for a serious defect
- Inoperable and a total loss.
- Custom built or modified for show or racing.
- Sold for less than $4,000.
- Driven more than 100,000 miles.
- Seven years of age or older from January 1 of its model year.
Only a car meeting one of those may be sold as is, with the disclaimer printed on the front page of the contract.
Three business days. A buyer of an as is car that is cheap, high mileage or older may cancel the sale by the end of the dealer's third business day after it, if the car has a significant mechanical issue that existed at the sale, by returning it to the point of sale.
