Hurt At Work
Wis. Stat. 102.12 — the employer on notice within 30 days, and an application within 2 years
Notice within 30 days. A Wisconsin compensation claim needs actual notice to the employer, or an officer, manager or designated representative, within 30 days after the injury or after the employee knew or ought to have known the disability and its link to the work. Where no representative is designated on posters, notice to any superior is enough.
Late or missing notice does not bar recovery if the employer was not misled by it.
2 years, if nothing is paid. If no compensation other than medical treatment or burial expense has been paid, and no application is filed with the department within 2 years after the injury or the date the employee knew or ought to have known, the right is barred, unless the employer knew or should have known of the injury within those 2 years.
