Seat Belts and Car Seats
W.S. 31-5-1402 — every occupant belted, a child under nine in a restraint, and no stop for a belt alone
- Every driver and passenger wears a properly adjusted and fastened safety belt while the vehicle moves on public streets and highways, and the driver makes sure passengers under twelve do.
- No vehicle is stopped solely for a seat belt violation.
- The driver may be fined up to $25 and a passenger up to $10, and a belted driver gets $10 off the fine for another offense.

A child who has not reached their ninth birthday rides in a child safety restraint system in a seat other than the front, unless the vehicle has one row or the rear belts are in use by other children, and never in a rear facing seat in front of an active airbag.
A first child restraint violation is a fine of up to $50, waived on proof of getting a proper restraint, and a later one up to $100.
