W.S. 40-17-101 — a defect reported in the first year, then a replacement or a refund
If a new vehicle under 10,000 pounds does not conform to the manufacturer's express warranty and the buyer reports it within one year after delivery, the manufacturer or its dealer makes the repairs, even after that year runs out.
Who handles this in Wyoming: Wyoming Attorney General, Consumer Protection Unit; and legal aid programs, lawyer referral and the state offices, listed in the Wyoming directory.
- If a defect that substantially impairs the vehicle's use and value cannot be fixed after a reasonable number of attempts, the manufacturer replaces the vehicle or takes it back and refunds the full price and collateral charges, less a reasonable allowance for use.
- A reasonable number is presumed when, within the first year, the same problem was repaired more than three times and continues, or the vehicle was out of service for a total of thirty business days.
- The presumption needs direct written notice to the manufacturer first and a reasonable chance to fix it, and the manufacturer's informal dispute program, if it has one, comes first.
A consumer harmed by a violation may sue and recover reasonable attorney's fees from the manufacturer.
