A Sale at the Door
W.S. 40-12-104 — until midnight of the third business day to cancel
A buyer may cancel a home solicitation sale, one over $25 solicited in person or by phone at the buyer's home and agreed to there, until midnight of the third business day after signing.
Who handles this in Wyoming: Wyoming Attorney General, Consumer Protection Unit; and legal aid programs, lawyer referral and the state offices, listed in the Wyoming directory.
- The clock does not start until the buyer has a copy of the contract, the address for the notice, and a written statement of the right to cancel.
- Cancelling takes written notice in any form to the seller's address in the agreement, and a mailed notice counts when it is posted.
- Within ten days after cancellation, the seller returns all payments and any trade in.
- The seller may keep a cancellation fee of five percent of the cash price, but no more than the down payment, and none if the seller did not follow these rules.
An emergency request. A buyer who asked for goods or services without delay because of an emergency cannot cancel once the seller in good faith has substantially begun, and goods cannot be returned in as good condition.
