When a Records Request Is Denied
W.S. 16-4-203 — a written statement of the grounds, citing the law relied on
A custodian denies inspection where a state or federal law, or a court rule or order, forbids it. Some records, like investigation files, test questions, and internal memos, may be withheld where disclosure would be contrary to the public interest, and others the law lists must be withheld.
Who handles this in Wyoming: legal aid programs, lawyer referral and the state offices, listed in the Wyoming directory.
The reason in writing. When access is denied, the requester may ask for a written statement of the grounds. It cites the law or regulation relied on and is given to the requester.
A requester may complain to the ombudsman or petition the district court. A person who knowingly or intentionally violates the act is liable for a penalty of up to $750, recovered in a civil action, and the court may assess damages.
