Jury Duty And Your Job
A.R.S. 21-236 — no penalty for serving, and no required use of vacation or sick leave
No penalty for serving. An Arizona employer may not refuse to let an employee serve as a juror, and may not dismiss or in any way penalize an employee for serving as a grand or trial juror. The employee keeps seniority and returns to the previous position or a higher one.
An employer may not require or request an employee to use annual, vacation or sick leave for time spent answering a jury summons, in jury selection, or serving. The employer does not have to pay for the time away.
For an employer with five or fewer full-time employees, the court postpones a summoned employee's service while another of its employees is serving. A violation of the section is a class 3 misdemeanor.
