21 Del. C. § 4802 — the driver and every occupant 16 or older, a $25 civil penalty, and no points
The driver wears a properly adjusted and fastened seat belt, and secures every occupant of the passenger compartment who is 16 years of age or older in one.
- On its own, a violation is a civil penalty of $25, and several unbelted people in one vehicle count as a single violation.
- No points are assessed, and nothing is entered on the driving record.
- Alongside another traffic offense, it adds an assessment and counts as an aggravating circumstance at sentencing.
