The Motorcycle Helmet
21 Del. C. § 4185 — a helmet carried by every rider, worn up to 19, and worn by a new rider for 2 years
- Every operator and passenger has an approved safety helmet in their possession, and wears approved eye protection.
- A person up to 19 years of age wears the helmet as well as the eye protection.
- A person who got a motorcycle endorsement on or after July 30, 2023, and any passenger with them, wears a helmet and eye protection for the first 2 years after the endorsement.
A violation is a civil or administrative assessment of $25 to $50, with no other assessment or court cost, and it may not be classified as a criminal offense.
A passenger rides only on a motorcycle built for more than 1 person, on a proper seat with footrests, and the operator keeps at least 1 hand on the handlebars while moving.
