Idaho Code § 37-2739C — no possession or paraphernalia charge from evidence found because someone sought help

The caller. A person acting in good faith who seeks medical help for someone in a drug-related medical emergency is not charged or prosecuted for possession, for using or being under the influence, or for paraphernalia, where the evidence was found because they sought help.

The person overdosing. The person having the emergency is not charged or prosecuted for the same offenses where the evidence was found because of the emergency and the need for medical help.
