Idaho Code § 33-205 — an informal hearing before a suspension, five school days, and written notice and a full hearing before an expulsion

Five school days. A principal or superintendent may temporarily suspend a student for disciplinary reasons, bullying included. The principal's suspension may not exceed five school days; the superintendent may extend it ten more, and the board, on a finding that return would endanger other students, five more.

Before suspending, the superintendent or principal grants an informal hearing on the reasons and a chance to challenge them.

  • Habitual truancy.
  • Conduct continuously disruptive of discipline or instruction.
  • A presence detrimental to the health and safety of other students.
  • A deadly or dangerous weapon or firearm on school property.
  • An expulsion or disenrollment from another school.

Before an expulsion. The board gives the parent written notice of the grounds and the time and place to contest them, with the student's rights to a lawyer, to bring witnesses and evidence, and to cross-examine adult witnesses, then a full and fair hearing after time to prepare.

Students with disabilities are disciplined under the federal special education law. A particular case is a question for the school district or a licensed Idaho attorney.
