Criminal Mischief
KRS 512.020 — damaging property, a Class D felony at $500 or more
- With no right to do so, intentionally or wantonly defacing, destroying or damaging property causing a loss of $500 or more is criminal mischief in the first degree, a Class D felony.
- Below $500 it is criminal mischief in the second degree, a Class A misdemeanor.
- Both apply to a tenant damaging residential rental property.
On a first offense, repairing or replacing the property, making full restitution, or doing the community service the court requires before trial makes first degree a Class B misdemeanor.
