KRS 367.842 — a defect not fixed in the first 12,000 miles or 12 months, and a replacement or refund
If the manufacturer cannot repair a warranty defect after a reasonable number of attempts during the first 12,000 miles or the first 12 months after delivery, whichever comes first, the buyer reports it to the manufacturer in writing.
If a defect that substantially impairs use, value or safety still is not fixed in that period, the manufacturer, at the buyer's choice, replaces the vehicle with a comparable one or takes it back and refunds the full price, with finance charges, sales tax and fees, less a reasonable allowance for use.
The law covers new vehicles bought or leased in Kentucky by a resident. It does not cover motor homes, motorcycles, mopeds, farm tractors, or vehicles with more than two axles. A buyer who loses money because of a violation may sue under the consumer protection act.
