Unfair and Deceptive Practices
KRS 367.170 — unfair, false, misleading or deceptive acts in trade are unlawful
Unfair, false, misleading or deceptive acts or practices in any trade or commerce are unlawful, and unfair here means unconscionable.
- A person who bought or leased goods or services mainly for personal, family or household use, and lost money or property because of such a practice, may sue for actual damages.
- The suit goes to the Circuit Court where the seller does business, where the buyer lives, or where the deal happened.
- The court may grant equitable relief and award reasonable attorney's fees and costs to the prevailing party, and punitive damages are not ruled out.
The suit is brought within two years after the violation, or within one year after any action of the Attorney General ends, whichever is later.
