Renting The Lot, Owning The Home
Real Prop. § 8A-1101 — eviction only for listed reasons, on thirty days written notice
In Maryland, a mobile home park owner may evict a resident only for nonpayment of rent; a knowingly false or misleading statement on the application for tenancy; a violation of law detrimental to the safety and welfare of other residents; or repeated violations of a park rule or the rental agreement within a 6 month period.
Thirty days and a specific reason. The park owner delivers a written notice of the violation, by certified mail, regular mail or personal delivery, at least 30 days before the date the resident must vacate. It is addressed to that resident and gives a specific reason for the eviction.
No lockouts. A park owner may not take or threaten to take possession by locking a resident out, or by willfully interrupting heat, running water, hot water, electricity or gas to force the resident out. Possession comes only through a court's warrant of restitution executed by a sheriff or constable, or after the resident has abandoned or surrendered the premises.
A resident who wins because the park owner broke that rule may recover actual damages and reasonable attorney's fees and costs, and those remedies are not the only ones.
