Door To Door Sales
MCL 445.112 — three business days to cancel
A home solicitation sale is a sale over $25 solicited in person, by phone or in writing, where the buyer receives the solicitation and agrees to buy at home. It does not include sales at the seller's business location, sales following negotiations there, sales from a printed advertisement, and several others the act lists.
Until midnight of the third business day. The buyer may cancel until midnight of the third business day after signing, in addition to any other right to revoke. Cancellation happens when the buyer mails or delivers the notice of cancellation, or any other written notice saying they do not intend to be bound, to the seller's address in the notice, and a mailed notice counts once it is in the mailbox. The seller may not have a courier or other third party pick up payment at the home before that period ends.
The written agreement has to state the right to cancel next to the buyer's signature, and come with a notice of cancellation form in duplicate.
Within 10 days after a cancellation the seller returns any payments and any note, and a trade in in substantially as good condition, or the buyer may recover the trade in allowance. The buyer makes the goods available at home, and if the seller does not demand them within 20 days, they become the buyer's without obligation. A seller who performed services before the cancellation is not entitled to be paid for them.
The right to cancel does not apply where the buyer asked for goods or services without delay in an emergency, the seller began in good faith, the buyer gave a separate handwritten, signed and dated statement describing the emergency and waiving the right to cancel within 3 business days, and goods cannot be returned in substantially as good condition.
