Replacement or refund. If the manufacturer cannot fix a defect that impairs the vehicle's use, market value or safety after a reasonable number of attempts, it replaces the vehicle with a comparable new one acceptable to the consumer, or takes it back and refunds the price, at the manufacturer's option.

  • The same defect was repaired four or more times and remains.
  • The vehicle was out of service for repair a total of thirty or more working days.

Either one, within the warranty or the first year, is presumed a reasonable number of attempts.
