Grandparents And Visitation
Neb. Rev. Stat. § 43-1802 — a death, a divorce or unmarried parents, and clear and convincing evidence of a beneficial relationship
- The child's parent or parents have died.
- The parents' marriage was dissolved, or a dissolution is pending.
- The parents never married, and paternity was legally established.
Clear and convincing evidence. In those cases a grandparent may seek visitation, granted where the court finds by clear and convincing evidence a significant beneficial relationship, that continuing it is in the child's best interests, and that it will not adversely interfere with the parent-child relationship.
