G.S. 25A-39 — until midnight of the third business day to cancel
Three business days. In North Carolina, a buyer may cancel a home solicitation sale until midnight of the third business day after the day they sign the agreement. Cancellation happens when the buyer gives the seller written notice at the address in the agreement, and a mailed notice counts when it is deposited, properly addressed and stamped.
The seller presents a fully completed written agreement in the language of the sales pitch, dated the day the buyer signs, with the seller's name and address, and next to the signature line in bold type of at least 10 points a statement that the buyer may cancel before midnight of the third business day, pointing to an attached cancellation form.
Unless the seller provides the required form, any written expression of the intention not to be bound is enough. A buyer who asked in a separate writing for urgent or emergency work cannot cancel once the seller has in good faith substantially begun, where goods cannot be returned in substantially as good condition. If delivery is more than 30 days late through the seller's fault, the buyer may cancel before accepting it and get a refund.
