N.D.C.C. § 5-01-08.1 — misrepresenting age to buy alcohol is a class B misdemeanor
Misstating one's own age or another's, or showing a document claiming legal drinking age, to buy alcohol is a class B misdemeanor. A licensee may ask someone whose age is in question to sign a book recording the ID used.
- A retailer checks age only by a valid photo driver's license or ID from any state or a Canadian province, a military ID, or a valid passport.
- A retailer may seize an ID reasonably believed altered, falsified or misused.
- It notifies law enforcement within twenty-four hours, and the agency takes the ID within twenty-four hours of notice.
