N.D.C.C. § 51-18-02 — three business days to cancel a sale made at home or by phone, fifteen at sixty-five and over
A personal solicitation sale is one the seller solicits by phone or in person, with the agreement made somewhere other than the seller's place of business. The buyer may cancel until midnight of the third business day after signing a compliant agreement.
- A buyer sixty-five or older may cancel a sale over fifty dollars until midnight of the fifteenth business day.
- The seller must tell the buyer of the right to cancel out loud, and the written agreement must carry the notice and a cancellation form.
- Cancelling takes written notice delivered, mailed, or emailed to the seller's stated address.
- Within ten days of cancelling, the seller returns the payments and any note, and ends any security interest.
