N.D.C.C. § 12.1-23-11 — using another's identifying information for value is a felony

Personal identifying information includes a name, address, phone, social security number, license number, account and card numbers, passwords, photos, biometric data and the rest of the section's list.

  • Using another's information, living or dead, without consent to get anything of value is a class B felony over $1,000 and a class C felony otherwise; a second offense is a class A felony.
  • Using it to open a service, get a job, or commit another offense, even with no loss, is a class A misdemeanor, and a second is a class C felony.
