Automobile Lemon Law 6 — three repairs, or 30 calendar days out of service, in the first year or 12,000 miles

The manufacturer of a new vehicle sold or leased and registered in Pennsylvania repairs, at no cost, any defect substantially impairing its use, value or safety that occurs within one year of delivery, the first 12,000 miles, or the warranty term, whichever comes first. A motorcycle's period is one year or the warranty. The buyer delivers the vehicle to an authorized facility, or gives written notice when it cannot be moved.

Three repairs, or 30 days. A reasonable number of attempts is presumed when the same defect was repaired three times and still exists, or the vehicle was out of service for it a total of 30 or more calendar days.

The buyer's choice. If the defect is not fixed, the manufacturer, at the buyer's option, replaces the vehicle with a comparable one of equal value or takes it back and refunds the full price with collateral charges, less use before the first report, not more than 10¢ a mile or 10% of the price, whichever is less. A refund is paid within 30 days of the election.

There is no refund or replacement when the defect does not substantially impair use, value or safety, or results from the buyer's abuse, neglect or alteration.
