A Relief From Abuse Order
15 V.S.A. § 1104 — an emergency order without notice on a finding of immediate danger of further abuse
A temporary order may issue ex parte, without notice to the other side, on a finding that the defendant abused the plaintiff or the plaintiff's children, supported by an affidavit that can be sworn over the phone. A minor 16 or older, or a minor of any age in a dating relationship, may ask on their own behalf.
- On a finding of immediate danger of further abuse, the order can require the defendant to stop abusing the plaintiff or the children, or harming a pet.
- Law enforcement officers enforce the orders, including by arrest, and help a person granted the home or custody get it if the defendant refuses.
- An order from another state is given full faith and credit.
