Unfair And Deceptive Practices
W. Va. Code § 46A-6-104 and W. Va. Code § 46A-6-106 — actual damages or $200, whichever is greater
Unfair methods of competition and unfair or deceptive acts or practices in any trade or commerce are unlawful.
$200 or the actual loss. A person who buys or leases goods or services and suffers an ascertainable loss of money or property from an unlawful practice may sue in circuit court for actual damages or $200, whichever is greater, with a right to a jury.
The buyer proves an actual out of pocket loss caused by the violation. For a misrepresentation, the buyer proves it caused them to enter the deal.
