Moving Over For Stopped Vehicles

Wis. Stat. 346.072 — a lane away from vehicles within 12 feet, or slow down

In Wisconsin, when an emergency or roadside service vehicle, or a disabled vehicle, is parked or standing on or within 12 feet of the roadway, an approaching driver proceeds with due regard for all other traffic and does one of two things.

  • On a road with at least two lanes going the driver's way, and where it can be done safely, moves out of the lane nearest the vehicle and stays out until clear.
  • On a one lane road, or where a lane change is not safe, slows to a safe speed until completely past.

A disabled vehicle is one stopped with warning or hazard lights on, with flares or other warning devices near it, or with people attending it in view. A violation also brings a suspension of the operating privilege.
