A Dismissed Case
Iowa Code § 901C.2 — expunged on application after an acquittal or dismissal, 180 days later
- The court expunges a criminal case in which every charge ended in an acquittal or a dismissal.
- All court costs and fees must be paid, and at least 180 days must have passed, unless the court waives that for a reason such as identity theft or mistaken identity.
- It does not apply to a case dismissed for insanity or incompetence.
