Unfair and Deceptive Practices
Iowa Code § 714H.5 — actual damages, costs and attorney fees for a consumer who loses money to deception
No one may engage in a practice they know or should know is unfair, deceptive, fraudulent, a false promise, or a concealment of a material fact, meaning others to rely on it, in advertising, selling or leasing consumer goods.
- A consumer who suffers an ascertainable loss of money or property may sue for actual damages.
- When the consumer wins actual damages, the court awards the costs of the action and reasonable attorney fees.
- The court may also order injunctive relief to protect the public.
