Dividing Property in a Divorce
15 V.S.A. § 751 — all property, however and whenever acquired, is divided equitably
On either spouse's motion, the court divides and assigns the property equitably. All property owned by either or both, however and whenever acquired, is within the court's reach, and whose name is on the title does not matter, except where equity can be done without disturbing separate property.
- The court may weigh the length of the marriage, each spouse's age, health, income and employability, and contributions to the other's education or earning power.
- It may weigh whether the division is instead of or in addition to maintenance, and each spouse's chance of acquiring assets and income later.
