9 V.S.A. § 4173 — after reasonable repair attempts or 30 days out of service, a written election to proceed
A defect in a new motor vehicle reported during the warranty term must be repaired by the manufacturer, even if the repair comes after the warranty ends. The dealer may not refuse a written repair order.
- After reasonable repair attempts, or 30 or more calendar days out of service, the consumer notifies the manufacturer in writing on its forms of the defect and the election to proceed.
- The consumer chooses the manufacturer's dispute mechanism or the Vermont Motor Vehicle Arbitration Board.
- Outside a settlement, any agreement waiving these rights, or requiring silence about them, is void.
