Unfair and Deceptive Practices

9 V.S.A. § 2461 — a consumer can recover damages, attorney's fees, and up to three times the consideration

Unfair methods of competition and unfair or deceptive acts or practices in commerce are unlawful, including in real estate transactions. Breaking a rule the Attorney General adopted under the section is prima facie proof of a deceptive act.

  • A consumer who contracted in reliance on, or was harmed by, a false or fraudulent practice may sue for equitable relief and damages, or the consideration given.
  • The consumer may also recover reasonable attorney's fees, and exemplary damages up to three times the value of the consideration.
  • Contract language trying to exclude those recoveries is unenforceable.
