When Your Data Is Breached
W. Va. Code § 46A-2A-102 — notice without unreasonable delay when the breach could cause identity theft
A business or person that owns computerized personal information gives notice of a security breach to every resident whose unencrypted information was, or is reasonably believed to have been, taken, if it causes or is reasonably believed to cause identity theft or fraud.
Without unreasonable delay. The notice is made without unreasonable delay, apart from time to find the scope of the breach and restore the system, or a delay law enforcement asks for.
The notice describes the kinds of information taken, such as social security numbers, license numbers or financial data, and gives a phone number or website to learn more.
